According to John Coghlan, Director, Buildspect Building Consultants, the firm has seen an increase in demand for defect and incomplete work inspections and court ready reports since this time two years ago. And he only sees demand growing as dispute numbers continue escalating moving forward.
“These issues are only likely to increase with the Government’s announcement of its $5.3 billion budget investment, known as The Big Housing Build, which is set to create thousands of new homes for Victorians, while adding an additional 10,000 jobs to the economy.
“Indeed, while it’s a very welcome injection into the sector, the mounting pressures are resulting in property industry experts calling for reforms to better protect buyers from purchasing substandard properties. Because at present, addressing the problems many face due to defects and incomplete work is often a very unclear process,” John Coghlan said. “And Australian Consumer Protection laws don’t extend to property purchases.”
There are five key building stages where disputes typically happen: base; frame; lock-up; fixing; and handover. And then at around the 5+ year mark. So, securing best practice defect or incomplete work reports from an experienced consultancy firm with the necessary resources to provide documentation that will, if needed, stand up in court to protect property investors’ assets is very important.
Most experienced property market players appreciate that it’s worth investing in the best building reporting possible to protect their investment in the immediate and longer-term. But now it seems every owner should be familiar with best practice to understand the stages building inspections should take place, what condition reports and owner builder reports should cover, and appreciate when building defects and building disputes occur, to ensure they are properly protected for each worst-case scenario. Otherwise they run huge risks in relation to the quality and longevity of their property investment.
“Essentially, you want an experienced team of experts with building experience on your side. Professionals who can turn reports around quickly to save you time and money and stand up in court when needed. Not a sole trader who doesn’t have the time and resources needed should things become demandingly problematic,” Mr Coughlan said.
“In addition, you would be better supported working with a consultancy firm that services lawyers, financiers, insurance firms, receiver managers, and strata management companies to comprehensively address the different requirements in each space for each service provider involved with a project.”
